Terms of Service
Version 1.0 · 16 September 2026
The short version. SquawkSMS gives you software to run a safety management system and to produce the documents that describe it. It does not make you compliant, it does not file anything with the FAA, and it does not replace the judgement of the people accountable for your operation. Those obligations remain yours.
1. Who these terms are between
These terms are between SquawkSMS ("we", "us") and the organisation that opens an account ("you", "the operator"). If you accept them on behalf of a company, you are confirming you may bind that company.
2. What the service is
SquawkSMS is software. It provides tools to record hazard reports, assess risk, track corrective actions and training, and to generate documents — including an SMS manual and a Declaration of Compliance — from information you enter.
What it is not:
- It is not a compliance service. 14 CFR Part 5 requires an organisation that manages safety. No product can do that on your behalf.
- It is not affiliated with, endorsed by, or approved by the FAA, and nothing it produces has been reviewed or accepted by the FAA by virtue of being produced here.
- It is not a filing service. You submit your own Declaration of Compliance. We never submit anything to a regulator for you.
- It is not legal or regulatory advice. Citations and intervals in the product are a starting point and are marked where they depend on facts we do not hold.
3. What you are responsible for
- The accuracy of what you enter. Documents are generated from your information; if that is wrong, the documents are wrong.
- Reviewing anything we generate before you rely on it, sign it, or file it. Anything the product cannot know is marked [DECISION REQUIRED] rather than filled with a plausible default, and it is your job to resolve those.
- Naming a real accountable executive and safety manager, and keeping your certificates and fleet current in the system.
- Who you give access to, and removing people who leave.
4. Your data is yours
You own everything you put into SquawkSMS. We store and process it to provide the service, and for no other purpose. We do not sell it, and we do not use your safety content to train models.
You can export your data at any time while your account is active. See the Privacy Policy for what we hold and who processes it.
5. Confidentiality of safety content
Our support console shows counts, activity and billing. It does not show the content of your hazard reports, risk assessments or manual. Reading your content requires you to grant time-boxed support access from inside your own account, which you can revoke, and which is logged where you can see it. That constraint is enforced in our database, not merely promised here.
6. Anonymous reporting
Where a report is filed anonymously, no reporter identity is recorded. It cannot be recovered afterwards by you, by us, or by anyone else, because it was never stored. This is deliberate and is not a limitation we can lift on request.
7. Plans, trials and payment
- Paid plans begin with a free trial. No card is required to start one.
- Subscriptions are billed in advance through Stripe. We do not see or store your card details.
- Prices are per operator. Annual billing is charged for twelve months at the rate shown when you subscribe.
- You may cancel at any time; access continues to the end of the period you have paid for. We do not pro-rate refunds for partial periods, but if something has gone wrong, write to us — we would rather fix it than keep money we have not earned.
- If payment fails we will tell you before access changes.
8. Suspension
We may pause an account for non-payment or for use that threatens the service or other customers. A paused account remains readable. You will not be able to file or edit, but you will be able to reach your records — locking an operator out of records they are required by regulation to retain is not something we will do.
9. Ending the agreement
You may close your account at any time. Ask us to delete it and we will, permanently. Safety records are append-only while an account is live, so individual records cannot be deleted on request — they can be superseded, which leaves the correction and the original both visible. That is the guarantee the product exists to provide.
10. Availability
We aim to keep the service available and to tell you when it is not. We do not currently offer a contractual uptime guarantee, and you should not design a procedure that depends on this software being reachable at a particular moment. Your safety obligations do not pause when a website does.
11. Warranties and liability
The service is provided as it is. We do not warrant that documents generated by it will satisfy any particular inspector, principal operations inspector, or audit, or that its content reflects the most recent regulatory interpretation.
To the extent the law allows, our total liability for any claim arising from these terms is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including loss of certificate, loss of business, or regulatory penalties.
Nothing here limits liability that cannot lawfully be limited.
12. Changes
We may change these terms. If a change materially affects you we will email the account's accountable executive before it takes effect, and the version and date at the top of this page will change.
13. Governing law
These terms are governed by the laws of the State of Nevada, United States, and the courts of Clark County, Nevada have exclusive jurisdiction.
